Always Current Monthly Support Plan Terms of Service

These terms are an agreement between Erin Clayton Creative ("ECC", "I", "me") and the person or business subscribing to the Always Current Monthly Support Plan ("you"). By ticking the terms box at checkout and completing payment, you agree to these terms.
1. What the plan includes
Up to three update requests per calendar month for one Squarespace website.
Each request covers one update of up to 30 minutes of work. Examples: text edits, photo swaps, price or hours updates, seasonal banners, adding a testimonial, fixing a link or button.
If you submit no requests in a calendar month, I will complete one SEO check of up to 30 minutes and email you a short summary with recommendations.
Unused requests expire at the end of each calendar month. They do not roll over and are not refundable.
2. How requests work
Requests must be submitted through the client request form, one update per form.
Requests received by Sunday at 8:00 pm Pacific Time will be completed by end of day the following Tuesday.
Requests received after the cutoff will be completed by end of day the Tuesday after that.
Where a statutory holiday in British Columbia falls on a Monday or Tuesday, completion moves to the next business day.
You are responsible for supplying final text, images and files. Timelines start once I have everything needed to complete the request.
Each request includes one round of corrections if the update does not match what you submitted. Changes of mind count as a new request.
3. Work outside the plan
Anything beyond three requests in a month, or beyond 30 minutes for a single request, is outside the plan.
So are new pages, redesigns, full copy rewrites, new functionality, custom code, and troubleshooting third-party tools.
I will send a written quote for out-of-plan work at my reduced rate for monthly subscribers of $100 per hour. No out-of-plan work starts until you approve the quote.
4. Fees and billing
The plan costs $197 CAD per month plus applicable taxes.
You authorize ECC to charge your payment method automatically each month, on the date you subscribed, until the plan is cancelled.
Payments are processed by Stripe. Fees are charged in advance and are non-refundable, including for partial months and unused requests.
I may change the monthly fee with at least 30 days' written notice by email. If you do not agree, you may cancel before the new fee takes effect.
5. Failed payments
If a payment fails, Stripe will retry it and you will be emailed.
Work on your requests pauses until payment succeeds.
If payment has not succeeded within 14 days, I may cancel your plan.
6. Cancelling
There is no minimum term. You may cancel at any time by emailing hello@erinclayton.com at least 7 days before your next billing date.
Your plan stays active until the end of the period you have paid for. Requests submitted before that date will be completed.
I may cancel your plan with 30 days' written notice, or immediately if payments fail or these terms are not followed.
7. Access to your website
You agree to keep ECC added as a contributor on your Squarespace site for as long as the plan is active.
If access is removed, I cannot complete requests. Fees remain payable while the plan is active.
8. Ownership and content
You own your website, domain and content. Nothing in this plan transfers ownership to ECC.
You confirm you have the right to use all text, images and files you ask me to publish, and you are responsible for their accuracy.
9. What I am not responsible for
Outages, bugs or changes on Squarespace or any third-party tool connected to your site.
Search rankings, traffic or sales results. The SEO check is a review with recommendations, not a guarantee of outcomes.
Errors in content you supplied.
10. Limit of liability
To the extent the law allows, ECC's total liability under these terms is limited to the fees you paid in the three months before the claim arose. ECC is not liable for indirect losses or loss of profits.
11. Changes to these terms
I may update these terms with at least 30 days' notice by email. Continuing your plan after the change takes effect means you accept the updated terms.
12. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
